Attica Interactive Ltd and Ordnance Survey ("the Owners") hereby grant you (either an individual or entity) a non-exclusive, non-transferable licence to use the software loaded on the CD-ROM ("the Software") in accordance with the terms of this licence agreement.
You may not copy, modify, alter, electronically transfer, decompile or reverse engineer the Software or the user instructions in any way, other than to make one copy of the Software for back-up purposes. It is also your responsibility to ensure that, before loading the Software, you have made adequate back-ups of the application software and data stored on your computer.
By clicking on the 'Yes' button below, you will be deemed to have accepted the terms of this licence agreement.
2. Restrictions
This licence is personal to you and you may not assign, transfer or sub-licence the Software or the user instructions to any other person without the express written consent of the Owners.
You have purchased a Single User version of the Software, therefore you may only use the Software on a single computer that you own or use.
Under no circumstances may you use it on more than one machine at a time. Once you have run the portion of the Software called the "set-up" program on your computer, you may use the Software on a different computer only if you first delete the files installed by the set-up program from the first computer.
Printouts of the maps, mapping components, text, graphics and statistical tables may be taken for your own use including use in educational and personal research documents and projects. Copyright in this material irrespective of its form of presentation will vest in the Owners. Printouts of maps, mapping components, text, graphics and statistical tables may not be taken and included in documents or publications either in print, photocopy or electronic form to be circulated for republication, promotional purposes or sale.
Copying or reproducing any of the photographs or video sequences in the Software either in print, photocopy or electronic form for any use whatsoever (whether for personal or commercial use) is strictly prohibited under any circumstances.
3. Warranties
The Owners warrant for a period of 30 days from the date of original purchase ("the Warranty Period") that under normal use the CD-ROM on which the Software is supplied will be free from defects in materials and workmanship and the Software will perform on systems with at least the minimum requirements specified substantially in accordance with the user instructions.
If a defect in the CD-ROM or the Software occurs during the Warranty Period, you may return it with proof of purchase and details of the supplier to Focus Multimedia Ltd, The Studios, Lea Hall Enterprise Park, Armitage Road, Rugeley, Staffs. WS15 1LH who will provide you with a replacement.
Subject to paragraph 4 below, the warranty given above, represents your only remedies for any breach of the Owners' warranties, which are given only to the original user of the Software.
Except as set out in this Licence Agreement, all warranties, conditions, undertakings, terms and obligations implied by statute, common law, trade usage, course of dealing or otherwise (including the implied warranties of satisfactory quality and fitness for a particular purpose) are hereby excluded to the fullest extent permitted by law.
4. Limitations of Remedies
The depiction of any road, path or track on mapping or photography included in the Software is no indication of public right of way and the Owners exclude all liability, (whether in contract, tort or otherwise) arising from the depiction of any such road, path or track in the Software.
The Owners liability for any direct loss arising from any defect in the CD-ROM or the Software is limited to your purchase price.
Except as set out in this Licence Agreement, in no event will the Owners or their group companies, licensors, suppliers or agents be liable to you for any loss or damage of any kind (except personal injury or death resulting from the Owners' negligence), including any loss of profits, loss of anticipated savings or other indirect or consequential damages arising out of your use or inability to use the Software or from errors or deficiencies in it, whether caused by negligence or otherwise.
5. Law
This Licence Agreement is governed by English law and the jurisdiction of the English courts.
